📱 1.2 Scope These Terms govern the use of the VocPro app, available through Google Play Store, Apple App Store and other platforms.

🌍 1.3 Contract Language Contract language is English. In case of conflicts between language versions, the German version prevails.

📚 2.1 App Features • Vocabulary training with Spaced Repetition technique • Pre-installed vocabularies (1889+ German-French-English) • Import custom CSV vocabularies (stored locally) • Three interactive learning games with scoring system • Personal learning statistics and progress tracking • Offline usage for imported vocabularies

📱 2.2 System Requirements • Android 7.0+ or iOS 12.0+ • Internet connection for registration and subscription management • Storage space for local vocabulary database

⏰ 2.3 Availability Target availability: 98%. Maintenance performed outside peak usage times.

👤 3. Usage Requirements

🔞 3.1 Prerequisites • Minimum age: 16 years • Valid App Store account • Acceptance of these Terms and Privacy Policy

📝 3.2 Registration Required data: • Email address (unverified) • Username • Password • Payment information (only for subscription)

🔐 3.3 User Account Confidential treatment of access credentials is mandatory. Change password immediately if misuse suspected.

💰 4. Pricing and Payments

🆓 4.1 Free Trial 14 days full access to all features at no cost.

💳 4.2 Subscription Options • Monthly subscription: Current App Store price • Annual subscription: 15% discount compared to monthly payments • No in-app purchases or hidden costs

🏪 4.3 Payment Processing All payments through App Store platforms (Google Play, Apple App Store). Their payment terms apply.

🔄 4.4 Automatic Renewal Subscriptions renew automatically. Cancellation required at least 24 hours before expiry.

↩️ 5. Right of Withdrawal

🇪🇺 5.1 EU Consumer Rights 14-day right of withdrawal without giving reasons from contract conclusion.

⚡ 5.2 Early Usage Using the app during withdrawal period waives withdrawal right upon express consent.

💸 5.3 Refunds Withdrawal and refunds through respective App Store platform.

🔑 6. Usage Rights

✅ 6.1 Granted Rights Non-exclusive, non-transferable usage right for private, non-commercial purposes.

❌ 6.2 Prohibited Usage • Reverse engineering or decompilation • Commercial redistribution without permission • Circumventing security measures • Illegal content or activities

📝 6.3 Custom Vocabularies Users can add custom vocabularies (stored locally only). User responsible for legality of their content.

🖥️ 7. Availability and Disruptions

☁️ 7.1 Hosting Infrastructure Backend services via Replit Inc. with autoscale deployment.

⚠️ 7.2 Availability Risks Service may be affected by: • Replit platform outages • Server or network problems • Maintenance work • Force majeure

🚫 7.3 Third-Party Disclaimer If Replit discontinues service, app may become permanently unavailable. Provider not liable for resulting damages.

💾 7.4 Backup Notice No regular backups performed. Users should additionally secure important vocabulary lists.

🔒 8. Data Protection

📊 8.1 Data Collection Only data for registration and payment processing (see Privacy Policy).

🏠 8.2 Local Storage • Custom vocabularies: only locally on user device • Learning statistics: only processed locally • No data transmission to servers

🇪🇺 8.3 GDPR Compliance GDPR provisions apply to EU citizens. Details in separate Privacy Policy.

📋 9. Termination

👤 9.1 User Termination Anytime via App Store account settings. Effective at end of billing period.

🏢 9.2 Provider Termination Ordinary termination: 30 days notice Extraordinary termination: for serious contract violations

🔚 9.3 Service Discontinuation For permanent discontinuation: 60 days advance notice via email. Pro-rata refund of unused subscription credits.

⚖️ 10. Liability and Warranty

✅ 10.1 Warranty App substantially corresponds to advertised features. Minor deviations without substantial impairment are permissible.

📏 10.2 Limitation of Liability Liability limited to intent and gross negligence. For simple negligence only for violation of essential contractual obligations.

🚫 10.3 Damage Exclusion Exclusion of liability for indirect damages, lost profits and consequential damages (where legally permissible).

💰 10.4 Maximum Liability Total liability limited to amount of last year's subscription fees.

📱 11. Google Play Store Terms

➕ 11.1 Additional Conditions Google Play Terms of Service apply additionally.

💳 11.2 Payments No in-app purchases. All payments as subscription via Google Play.

⭐ 11.3 Reviews Users can rate the app. Provider reserves right to respond.

🔄 12. Terms Changes

📝 12.1 Right to Modify Changes for important reasons with 30 days notice. Notification via email or app notification.

❌ 12.2 Right to Object Objection to substantial deteriorations possible within 30 days.

🚪 12.3 Right to Terminate Extraordinary termination possible for unreasonable changes.

📋 13. Final Provisions

🇫🇷 13.1 Applicable Law French law applies. Mandatory consumer protection provisions remain unaffected for EU consumers.
